Tax return filing when Spouse has no social security number?

handu asked:

Hi
Me and my wife are new to USA and since she is not working she does not have a social security number. For filing taxes either separately or jointly all tax softwares (Turbo, HR etc) ask for the spouses social security number.
Since I dont have that I am not allowed to file fed return online.
Is there a way I can file online, what social security number should I enter in case I need to enter a dummy number ?
Thanks

You need to apply for an ITIN number using form W7 and mail the application, your tax return leaving the space blank for her number and the required documentation to the IRS in Austin TX per the instructions for the W7

You can not efile your return, and it is illegal to use a bogus number

If you are both legally in the country and allowed to work, you both must have SSNs. Your wife should apply for her SSN immediately. It can take several weeks for the application to be processed and you will not be able to file a joint return with her until she has her SSN. If she doesn’t have her SSN by the filing deadline (April 17, 2007) you can file an appliation for an automatic extention of time to file your return, Form 4868. You should pay any tax due with the Form 4868. Then file your tax return when your wife gets her SSN.

If you wife is not permitted to work in the US, she must get an ITIN from the IRS. You can attach Form W-7 to your joint return and file a paper return with the Austin, TX service center. It’s not possible to e-file the ITIN application.

If your wife is eligible for an SSN, she CANNOT get an ITIN; she MUST get an SSN.

You have to obtain a Taxpayer Identification Number for her. Are you filing a 1040 or 1040nr? There might be some tax benefits available to you depending on your tax residence and your time in the US. If you have any questions I am a CPA and you can email me @.
